Terms of Service

Effective October 21, 2026

These terms are an agreement between you and SecondOrder Systems LLC (“SecondOrder,” “we,” “us”), a New Jersey limited liability company, covering your use of secondordersystems.com and everything on it: the content, the Audit, the free tools, the forms, and the trial sign-up. By using the site you accept them. If you do not, please do not use the site.

A managed build, trial, custom build, or Advisory or other leadership engagement is governed by a separate signed client agreement. Where that agreement and these terms disagree, the signed agreement wins for that engagement.

1. What the site is

The site describes what we build and run for landscape and field-service companies, offers free self-serve tools and a self-assessment (the Audit), and lets you start an inquiry or a trial. Reading the site, taking the Audit, running a tool, or submitting a form creates no obligation on either side. A commitment begins only when a client agreement is signed or a trial is started under section 5.

2. Who may use it

The site is for businesses and the people who run or work in them. You must be at least 18 and, if you act for a company, authorized to do so. You agree not to use the site to send spam, probe or overload our systems, scrape content, submit false information, or do anything unlawful. The forms are rate-limited and carry bot-detection fields; submissions that trip them are discarded.

3. Free tools

Renewal Radar, Payer Risk Check, downloadable templates, and any tool we later add to the Resources page are provided free, as is, to help you look at your own numbers. They run on data you load yourself, in your own browser, and the results are only as good as the export you give them. They are not accounting, legal, or financial advice, and they do not replace your own judgment or your accountant’s. Check anything that matters against the system of record before acting on it. We may change, pause, or retire a tool at any time.

You keep all rights to the data you load. We do not receive it (see the Privacy Policy); if you choose to email yourself a summary, you give us permission to store and send the headline figures you saw on screen.

4. The Audit

The Audit scores your answers and returns a band and a 90-day plan. It is a structured opinion, not a diagnosis, and it reflects only what you told it.

5. Trials, billing and cancelling

A build may offer a 30-day trial. It starts with an account signup, which includes your billing details. Your card goes straight to Stripe, our payment processor; we never see or store the card number. Nothing is charged during the trial. Before the trial ends we confirm the plan and price with you in writing, and billing begins only on the plan you accepted, as described in your client agreement or order confirmation. If you cancel during the trial, we remove our access from the server in your account, delete our copy of your credentials, and charge nothing; the account and server remain yours to keep or close. Prices, buyout terms, and what is included are stated in your client agreement, not on this site, and may differ by engagement.

The 30-day trial applies only to the ready-made builds listed on the site. Custom builds have no trial and are billed as quoted in writing. Advisory has no trial either: it is billed monthly from the first month under a separate signed order form, month to month. The first month, which we call the Game Plan, is invoiced after its first session, not before. If you tell us before the second session that it was not worth it to you, that invoice is cancelled and nothing is owed for it.

Ongoing service is month to month unless your agreement says otherwise. After the trial you may cancel at any time with 30 days’ written notice, and there is no cancellation fee. Service continues through the last day of the paid month in which the notice period ends; partial months are not refunded. When service ends, you keep your data, including the history the reports have built up, and the server and cloud account in your name. Our administrator access, monitoring, scheduling, the software we run for you, and any keys or services we supply under our own accounts end with the engagement. A license to that software and its documentation, for you to run yourself, is available as a one-time purchase on the terms set out in your agreement.

6. Your data and your platforms

Anything you upload, email, or connect stays yours. You are responsible for having the right to share it with us and for complying with the terms of any software platform you use with our work. Every engagement runs on credentials you hold and can revoke. We do not resell access to any third-party platform or its data; we are paid for what we build and operate.

7. Our content

The text, templates, tools, designs, and marks on this site belong to SecondOrder or its licensors. You may read, print, and share pages for your own business use, and use the downloadable templates inside your own company. You may not resell, republish, or rebrand them, or use our name or marks to suggest an endorsement, without written permission. Feedback you send us may be used to improve what we offer, without obligation to you.

SecondOrder is independent. We are not affiliated with, endorsed by, or a reseller of Aspire Software, ServiceTitan, or any other platform named on this site; their names are used only to identify the systems our clients already run. Links to other sites are for convenience; we are not responsible for their content or their practices.

9. No guarantees

We work hard to keep the site accurate and the tools correct, but everything on the site is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. Nothing on the site is a promise of a business result: your renewals, collections, margins, and hiring depend on decisions and conditions we do not control. Results described on the site, including anonymized operator examples, are illustrations, not predictions.

10. Limitation of liability

To the fullest extent the law allows, SecondOrder and its members and contractors are not liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the site or the free tools, even if we were told such damages were possible. Our total liability for anything connected to the site or the free tools is limited to one hundred US dollars. Liability under a signed client agreement is governed by that agreement. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

11. Indemnity

You agree to cover us against claims, losses, and reasonable legal costs that arise from your misuse of the site, your breach of these terms, or data you provided that you did not have the right to share.

12. Ending access

We may suspend or end your access to the site or a tool if you break these terms or put the site or other users at risk. You may stop using the site at any time, and you may ask us to delete your information as described in the Privacy Policy.

13. Governing law and disputes

These terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. If something goes wrong, email us first; most issues are fixed in a conversation. Any dispute that cannot be resolved that way will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest still applies.

14. Changes

We may update these terms. The effective date at the top shows the current version, and continued use of the site after a change means you accept it. A change that materially affects an active trial or engagement will be sent to you by email before it applies.
